Debris hauler, Alpha School and marina charters face Miami Beach code cases Monday
A Miami Beach magistrate takes up 43 code cases Monday, among them nine against one construction-debris hauler and several over late-night charter trips at the city marina.
A construction-debris hauler, a company named Alpha School 33141 LLC and two charter boat operators at the Miami Beach Marina are among the businesses facing code cases before the city’s special magistrate on Monday, Nov. 2, according to the city’s hearing agenda.
The 11-page agenda lists 43 cases, scheduled from 9 a.m. to 2:30 p.m., in the Commission Chamber at City Hall, 1700 Convention Center Drive. Most of the businesses have appealed their citations. The fines below are the ones listed in the city’s notices. The magistrate can uphold, change or throw them out.
The cases
- Construction debris: G 7 Holdings Inc., listed as doing business as Garbageman.com, has nine appealed cases at construction sites on Lakeview Drive, Royal Palm Avenue, West 30th Street, North Bay Road, Pine Tree Drive and Alton Road. Inspectors cited roll-off containers placed without the city’s construction-and-debris permit, with $5,000 first-offense fines in three cases. Other cases involve dirt tracked onto the street from 1901 Alton Road, using a city sidewalk without a permit, and construction noise before 8 a.m. on Pine Tree Drive. That noise case is listed as a third offense, with a $3,000 fine.
- Alpha School 33141 LLC: The company was cited for operating at 6801 Collins Ave. without a city business tax receipt and has appealed. The record does not say what the business does at the address.
- Marina charters: Inspectors cited 7X Charters LLC for running the vessel L’Chaim as a charter at the city-owned marina without a business tax receipt. A second offense, listed at 11 p.m., carries a $1,000 fine. Three cases against Weston Marine LLC say its vessel was running a charter that arrived at 9:30 p.m., when city code bars commercial boat activity at public marinas from 7 p.m. to 7 a.m. Those cases are marked closed on the agenda.
- Ocean Drive condo: The Penguin Condominium Association at 1418 Ocean Drive was cited over paint that inspectors said ran off the property into the alley and a city storm drain. Its two notices carry fines of $500 and $1,000, and both are under appeal.
- Short-term rentals: Several cases involve Airbnb listings in South Beach and North Beach buildings, either in districts where rentals of less than six months are banned or without a city business tax receipt.
Contractors at two North Bay Road home construction sites have also appealed citations under the city’s construction parking rules, which require workers to park on the site or at approved locations. At one site, the notices list fines that climb from $5,000 to $15,000.
Agendas and case records are on the city’s special magistrate portal. The Special Magistrate office can be reached at 305.673.7181.
